NAMCOR LTD is registered in the UK. Any personal information provided to us is governed by the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and where applicable, the European General Data Protection Regulation (EU GDPR).

II. For what purposes and on what bases will your data be processed?

The personal data we collect from you and process can be used to:

  1. Respond to Inquiries: Reply to your messages, consultations, and requests for information about our bespoke services, based on our legitimate interest in engaging with potential clients.

  2. Fulfil Contractual Obligations (Bespoke Travel Orchestration): Enable you to make a reservation, manage, and deliver your confirmed travel itinerary, including flights, accommodation, transfers, and exclusive experiences. Your data is processed for the purpose of fulfilling our contract with you.

  3. Provide Personalized Concierge Service: Offer an optimal guest experience and provide the same personalized, seamless service for future bookings. Your data is processed based on our legitimate interest in running our luxury business and perfecting the services we offer.

  4. Manage and Process Payments: Handle financial transactions for deposits, final payments, and manage any irregularities. Your data will be processed for the purpose of fulfilling our contract with you and to comply with a legal obligation (e.g., anti-money laundering regulations).

  5. Marketing and Communication: Manage newsletter subscriptions and provide you with information and special offers concerning our services. Your data will be processed with your consent or based on our legitimate interest if you are an existing client.

  6. Secure and Improve Website Use: Monitor, secure, and improve the function of our Website. Your data will be processed based on our legitimate interest in managing and protecting our systems against fraud and optimizing user experience.

  7. Manage Accounting and Disputes: Manage accounting and financial matters and potential disputes. Your data will be processed to comply with a legal obligation and for the purpose of fulfilling our contract with you.

You may withdraw your consent at any time, without affecting the lawfulness of processing operations carried out previously with your consent.

III. Are you obliged to provide us with your personal data?

The data we require for the above purposes (e.g., name, contact details, passport information for booking) are marked as required on our relevant forms. If you do not provide the necessary data, we will be unable to provide you with your chosen services or fulfil your bespoke travel request.

Data not marked as required are optional and enable us to find out more about you and further refine the services we offer.

IV. How long will we retain your data for?

Your data will be retained strictly for the period of time necessary to fulfil the following purposes:

  • Manage Client Relationship & Bookings: Retained for the duration of your active client relationship and for five years after the end of your last booking with us, for repeat service provision, audit, and legal defense.

  • Passport/API Details: Retained solely for the duration of the booking process, and deleted immediately after the successful completion of the trip, unless prior consent is given for faster future bookings (up to 3 years).

  • Payment Details: Retained until the relevant transaction has been completed and for up to ten days after the end of the trip for final charge reconciliation. Encrypted details (excluding 3-digit security code) may be retained for 13 months with your prior consent.

  • Manage Newsletter/Marketing: Retained for as long as your subscription is active. If we do not hear from you (e.g., no opens/clicks) for three years, your data will be deleted.

  • Financial/Accounting Records: Retained for six years after the relevant financial year end, to comply with UK tax law.

V. Who will your data be transferred to?

Your data will be communicated or transferred strictly on a need-to-know basis to external entities required to execute your booking:

  • Travel Providers: (Airlines, Hotels, Resort Chains, Private Villa Operators, Cruise Lines, Ground Transport, and Tour Operators) to execute your itinerary.

  • Booking Systems: (Global Distribution Systems (GDS), B2B booking platforms, and payment gateways (e.g., Stripe, PayPal)) to secure reservations and process payments.

  • Insurance Providers: (Travel insurance companies) if you purchase a policy through us.

  • Legal/Regulatory Bodies: (Government authorities, e.g., API/Border Control, or courts of law) if required by legal obligation.

We will only transfer your data to a third party if required to provide the service you have requested, to comply with a legal obligation, or if you have given your express prior consent.

VI. Will your data be transferred outside the European Economic Area?

As a luxury travel agency, data transfers outside the European Economic Area (EEA) and the UK are frequent and essential to deliver our services (e.g., booking a hotel in the Caribbean or Africa).

Any of your data transferred to countries outside the EEA/UK are transferred subject to appropriate safeguards, primarily the use of Standard Contractual Clauses (SCCs) approved by the UK and EU.

VII. Data Security and Confidentiality

NAMCOR LTD has implemented technical and organizational security measures in accordance with industry standards to safeguard the confidentiality and security of your personal data, ensuring they are not corrupted, damaged, or accessed by unauthorized third parties. All booking data is stored on secure, encrypted servers.

VIII. Payment Security

Payments made by bank card will be processed by a secure system using encryption protocols (e.g., SSL/TLS). We do not store sensitive payment data (such as the 3-digit security code) on our own systems.

IX. What are your rights?

You have the following rights concerning your personal data:

  • Right of Access: To request a copy of the personal data we hold about you.

  • Right to Rectification: To have inaccurate data corrected.

  • Right to Erasure ('Right to be Forgotten'): To request that your data be deleted, where applicable.

  • Right to Portability: To receive your data in a structured, commonly used format.

  • Right to Restrict Processing: To limit how your data is used.

  • Right to Withdraw Consent: To withdraw consent where processing is based on consent (e.g., marketing).
